By accessing or using Brief2Prod, operated by XappyTech Inc. ("the platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organisation. By using the platform, you represent that you meet these requirements.
Brief2Prod is an AI-assisted email production platform. It enables users to create campaign briefs, generate email design options, review and edit content, produce production-ready HTML, and export to email service providers (ESPs) including Klaviyo, Mailchimp, HubSpot, Salesforce Marketing Cloud, Braze, and Iterable.
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@brief2prod.com if you suspect unauthorised access.

Brief2Prod uses Anthropic's Claude API to generate email designs and HTML. You are responsible for reviewing all AI-generated content before sending it to your audience. We do not guarantee the accuracy, appropriateness, or legal compliance of AI-generated content. You retain ownership of content you input, and you own the outputs generated from your inputs.
When you connect your ESP accounts (Klaviyo, Mailchimp, HubSpot, etc.), you authorise Brief2Prod to act on your behalf to create and manage email templates. You are responsible for ensuring your use of those integrations complies with the respective platform's terms of service.
You are solely responsible for ensuring your email campaigns comply with applicable laws including CAN-SPAM, GDPR, CASL, and other anti-spam regulations. Brief2Prod includes technical features (List-Unsubscribe headers, unsubscribe tokens) to assist compliance, but legal responsibility remains with you.
Brief2Prod and its original content, features, and functionality are owned by Brief2Prod and are protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the platform without our express written consent.
To the maximum extent permitted by law, Brief2Prod shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
We reserve the right to suspend or terminate your access to the platform at any time, with or without notice, if we believe you have violated these Terms. You may close your account at any time by contacting us.
We may modify these Terms at any time. We will notify you of material changes by updating the date at the top of this page. Continued use of the platform after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Ontario, Canada. Any disputes shall be resolved through informal negotiation first, followed by binding arbitration in Toronto, Ontario, Canada.
